1. Data Processing Controller
Unless otherwise stated, the controller responsible for the data processing described in this privacy policy is Uncharted Hotels, based in Root, Switzerland.
2. Contact
To exercise your data protection rights according to section 8, or if you have general questions or concerns about this privacy policy, please use our contact form for data subject rights.
3. Origin of Personal Data
Often, you provide personal data to us yourself, for example, when you submit data to us or communicate with us. Providing personal data is usually voluntary, so you are generally not obliged to share your personal data with us. We may also collect personal data about you ourselves or automatically, for example, when you use our services.
3.1 Cookies
Our website partially uses cookies to make our offer more user-friendly, effective, and secure. Cookies can also be used to track and trace the origin of orders in partner programs. See section 5 for more details.
3.2 Server-Log-Dateien
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and version
- Operating system used
- Referrer URL
- Hostname of the accessing computer
- Time of the server request
- IP address
These data are not combined with other data sources. The collection of this data is based on Art. 6 Abs. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this, the server log files must be recorded.
3.3 Communication (Contact Form, Email, etc.)
If you send us inquiries via contact form, email, or similar, all data from your inquiry, including all resulting personal data, including the contact details you provide, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not share this data without your consent.
3.4 Registration
You can register on our website to use additional features on the site. The data entered for this purpose will only be used for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.
For important changes, such as the scope of offers or for technically necessary changes, we use the email address provided during registration to inform you in this way.
The processing of the data entered during registration is based on your consent (Art. 6 Abs. 1 lit. a DSGVO). You can revoke your consent at any time. An informal notification via email to us is sufficient for this. The legality of the data processing already carried out remains unaffected by the revocation.
The data collected during registration will be stored by us as long as you are registered on our website and will then be deleted. Legal retention periods remain unaffected.
4. Main Purposes and Legal Bases for Processing
In summary, we process personal data for the following purposes:
- Information and marketing (section 4.1);
- Market research and product development (section 4.2).
4.1 Information and Marketing
We process personal data for relationship management and marketing purposes, e.g., to send you newsletters and offers and to conduct marketing campaigns. These may include our own offers or those of partners. Messages and offers can be personalized. We may use technologies to determine whether recipients have opened the message or interacted with electronic marketing communications in other ways.
If we ask for your consent, e.g., when you subscribe to a newsletter, our basis for this processing is your consent (Art. 6 Abs. 1 lit. a DSGVO). In section 8, you will find information about your right to withdraw your consent or to object to the processing.
4.2 Market Research and Product Development
We process personal data to improve our services, e.g., by analyzing data on the use of our services. The basis for this processing is our legitimate interest (Art. 6 Abs. 1 lit. f DSGVO).
5. Partner Programs
Based on our legitimate interests (i.e., interest in the economic operation of our online offering within the meaning of Art. 6 Abs. 1 lit. f. DSGVO), we participate in several partner programs designed to provide a medium for websites through which advertising cost reimbursement can be earned by placing links. When clicking on advertising media, cookies may be set on your device. These cookies contain IDs that provide information about the website operator, the advertising media, the time of contact, and the advertiser. This information is used to process the commission claims of the website operator in the event of a measured conversion (e.g., a sale or registration). In addition, information about the device (anonymized IP, operating system, browser version) is collected to improve the service and prevent misuse. You can configure your browser to determine whether and to what extent cookies are allowed. However, please note that restricting cookies may impair the use of websites.
6. Email Marketing
The following information informs you about the content of our newsletter as well as the registration, dispatch, and statistical evaluation procedures and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the described procedures.
6.1 Content of the Newsletter
We send newsletters and other emails with promotional information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. If the contents of the newsletter are specifically described during the registration, they are decisive for the consent of the users. Otherwise, our newsletters contain information about travel topics, particularly hotels, flights, credit cards, and other relevant services and products.
6.2 Double-Opt-In and Logging
Registration for our newsletter generally follows a double-opt-in procedure. Therefore, you will receive an email after registration in which you are asked to confirm your registration. This confirmation is necessary so that no one can register with external email addresses. The registrations for the newsletter are logged to be able to prove the registration process according to legal requirements.
6.3 Communication (Contact Form, Email, etc.)
If you send us inquiries via contact form, email, or similar, all data from your inquiry, including all resulting personal data and the contact details you provide, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not share this data without your consent.
6.4 Success Measurement
The newsletters contain a so-called “web-beacon,” i.e., a pixel-sized file that is retrieved from the server of the dispatch service provider when the newsletter is opened. During this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, is initially collected. This information is used to improve the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined using the IP address) or the access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened, and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is not our intention to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
6.4 Termination/Revocation
You can cancel the receipt of our newsletter at any time, i.e., revoke your consents. A link to cancel the newsletter can be found at the end of each newsletter. Alternatively, you can revoke your consent at any time by sending an email to dataprotection@unchartedhotels.com. If users have only subscribed to the newsletter and have canceled this registration, their personal data will be deleted after 7 days.
7. Data Security
We take appropriate technical and organizational security measures to protect your personal data against unauthorized or unlawful processing and against the risk of loss, accidental alteration, unintended disclosure, or unauthorized access. However, like all companies, we cannot completely exclude data security breaches; certain residual risks are unavoidable.
8. Your Rights Regarding Your Personal Data
You have the right to object to the processing of your data, especially if we process your personal data based on a legitimate interest and the applicable conditions are met. You can also object to data processing related to direct marketing (e.g., advertising emails) at any time. This also applies to profiling, to the extent that it is related to such direct marketing.
If the applicable conditions are met and no legal exceptions apply, you also have the following rights:
- The right to request information about your stored personal data;
- The right to correct inaccurate or incomplete personal data;
- The right to request the deletion or anonymization of your personal data;
- The right to restrict the processing of your personal data;
- The right to receive certain personal data in a structured, commonly used, and machine-readable format;
- The right to withdraw a consent given for the future, provided the processing is based on consent.
Please note that these rights may be limited or excluded in individual cases, e.g., if there are doubts about your identity or if this is necessary to protect other persons, safeguard legitimate interests, or comply with legal obligations. If exercising certain rights incurs costs for you, we will inform you in advance.
In general, exercising these rights requires that you prove your identity (with a copy of your passport or ID, if your identity is not otherwise apparent or cannot be verified otherwise).
You can exercise these rights as follows:
- By unsubscribing from newsletters and other advertising emails, usually at the end of the email.
- by sending an email to dataprotection@unchartedhotels.com
9. Changes to Our Privacy Policy
This privacy policy may be adapted from time to time without prior notice. The current version published on our website applies.
